These Terms & Conditions ("Terms") govern your access to and use of the Retro Connect platform, including the Retro Connect mobile applications, the Retro Connect Business application and the website at retroconnect.in (collectively, the "Platform"). The Platform is operated by Retro Connect ("we", "us" or "our"). Please read these Terms carefully before using the Platform.
1. Acceptance of Terms
By downloading, accessing or using the Platform, creating an account, or listing a business, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding contract under applicable law to create an account or list a business on the Platform. By using the Platform, you represent that the information you provide is accurate, current and complete.
3. Account Registration & Security
- You may be required to verify your mobile number through a one-time password (OTP) to create an account.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must notify us immediately of any unauthorised use of your account at support@retroconnect.in.
- We may refuse, suspend or terminate accounts that contain false information or are created for fraudulent purposes.
4. Acceptable Use
You agree not to:
- Use the Platform for any unlawful, misleading, fraudulent or harmful purpose.
- Post false, defamatory, obscene, discriminatory or infringing content.
- Impersonate any person or business, or misrepresent your affiliation with any person or business.
- Use automated scripts, bots, scrapers or harvesting tools to access or extract Platform data without our written permission.
- Interfere with, disrupt or attempt to gain unauthorised access to the Platform, its servers or networks.
- Send spam, unsolicited marketing or bulk messages to customers or businesses through the Platform.
5. Business Listings & Merchant Responsibilities
- Merchants are solely responsible for the accuracy of their listing information, including business name, address, contact details, services, prices, offers, photographs, certifications and working hours.
- Merchants must possess all licences, registrations and permissions required to offer their services and must comply with all applicable laws and regulations.
- Merchants must honour the prices, offers and service commitments published on their listing and treat customers fairly and professionally.
- We may edit, reject or remove any listing that is incomplete, misleading, duplicated or in violation of these Terms, without prior notice.
6. Customer Responsibilities
- You are responsible for the accuracy of the enquiries, reviews and other information you submit.
- You must deal with merchants directly and exercise your own judgement before engaging any service. Prices, availability, quality and warranties are agreed solely between you and the merchant.
- You must not misuse merchant contact details, including for harassment, spam or unauthorised marketing.
7. Reviews, Ratings & User Content
- Reviews must reflect genuine, first-hand experiences. Fake, incentivised, abusive or promotional reviews are prohibited.
- By submitting content (reviews, photos, replies, reports or feedback), you grant us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce and distribute that content on the Platform and in our marketing.
- We may moderate, edit or remove content that violates these Terms or applicable law. Merchants may respond publicly to reviews through the Platform.
- You retain ownership of your original content, subject to the licence granted above.
8. Enquiries & Communications
When you submit an enquiry, the relevant merchant receives your name, contact details and message so they can respond to you. By submitting an enquiry you consent to being contacted by that merchant in relation to your request. You may also receive service notifications, transactional messages and, where permitted, promotional communications from Retro Connect. You can manage notification preferences in the app settings.
9. Subscriptions, Fees & Payments
- Basic business listings are free. We may offer optional paid subscription plans with additional visibility, tools and features.
- Paid plans, fees, billing cycles and inclusions are described in the app at the time of purchase and may be updated from time to time.
- Payments are processed by third-party payment providers. By purchasing a subscription, you agree to the terms of the applicable payment provider.
- Unless required by law or expressly stated otherwise, fees paid for a billing period are non-refundable. You may cancel auto-renewal at any time; access continues until the end of the paid period.
- Taxes, where applicable, are charged in addition to the listed fees.
10. Intellectual Property
The Platform, including its software, design, logos, trademarks, text and compilations, is owned by or licensed to Retro Connect and is protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer or create derivative works from the Platform without our prior written consent.
11. Third-Party Services & Links
The Platform may contain links to third-party websites, maps, payment gateways and services. We do not control and are not responsible for the content, policies or practices of third parties. Your use of third-party services is subject to their own terms and privacy policies.
12. Suspension & Termination
- You may stop using the Platform at any time and may delete your account from the app settings.
- We may suspend or terminate your access, with or without notice, if you breach these Terms, misuse the Platform, create risk to other users, or where required by law.
- On termination, sections that by their nature should survive (including intellectual property, disclaimers, liability limits and governing law) will continue to apply.
13. Disclaimers
The Platform is provided on an "as is" and "as available" basis. While we take reasonable steps to keep listings accurate and the Platform available, we do not warrant that listings, reviews, ratings, prices or offers are accurate, complete or current, that merchants will perform as described, or that the Platform will be uninterrupted or error-free. Retro Connect is a discovery and communication platform only and is not a party to any transaction or agreement between customers and merchants.
14. Limitation of Liability
To the maximum extent permitted by law, Retro Connect and its officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or business opportunity, arising out of or relating to your use of the Platform. Our total aggregate liability for any claim arising from the Platform shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) INR 5,000.
15. Indemnification
You agree to indemnify and hold harmless Retro Connect and its officers, employees and agents from and against any claims, losses, liabilities, damages and expenses (including reasonable legal fees) arising out of your use of the Platform, your content, your listing, or your breach of these Terms or applicable law.
16. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Subject to applicable law, courts in India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform. We encourage you to contact us first at support@retroconnect.in so we can try to resolve any concern informally.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Platform, law or our practices. When we make material changes, we will update the effective date and provide notice through the Platform or by other reasonable means. Your continued use of the Platform after the updated Terms take effect constitutes acceptance of the revised Terms.
